These Terms of Service ("Terms") govern your use of SavePoint software and services. By downloading, installing, or using SavePoint, you agree to be bound by these Terms.

1. License Grant

Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable license to use the SavePoint software for your personal or business radio broadcasting purposes.

License Tiers

  • Free Tier: Limited functionality for evaluation purposes
  • Broadcast License: Full access to all features for a single user

Activation Limits

Each license may be activated on a limited number of machines as specified at the time of purchase. You may deactivate licenses from machines through your account dashboard.

2. Acceptable Use

You agree to use SavePoint only for lawful purposes and in accordance with these Terms. You will not:

  • Use the software to broadcast content you do not have rights to
  • Attempt to circumvent license activation or validation systems
  • Reverse engineer, decompile, or disassemble the software
  • Share, sublicense, or transfer your license to others
  • Use the software for any illegal broadcasting activities

3. User Content

You retain all rights to the audio content you broadcast using SavePoint. We do not claim ownership of your music library, playlists, or broadcast content.

You are solely responsible for:

  • Ensuring you have proper rights to broadcast your content
  • Compliance with music licensing and copyright laws (e.g., ASCAP, BMI, SESAC)
  • The nature and legality of your broadcasts

4. Subscription and Payments

Billing

Paid subscriptions are billed in advance on a recurring basis (monthly or annually, depending on your selected plan). Your subscription will automatically renew unless cancelled.

Cancellation

You may cancel your subscription at any time through your account dashboard. Cancellation will take effect at the end of your current billing period.

Refunds

We offer refunds within 14 days of initial purchase if you are unsatisfied with the software. Refund requests should be submitted through our support system.

5. Software Updates

We may release updates, patches, or new versions of the software from time to time. Some updates may be required to continue using the service.

6. Service Availability

While we strive for high availability, we do not guarantee uninterrupted access to our license validation servers or account services. The core software functionality operates locally and does not require constant internet connectivity.

7. Intellectual Property

SavePoint and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, and other intellectual property laws.

8. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT.

9. Limitation of Liability

IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES.

10. Termination

We may terminate or suspend your access to our services immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any significant changes by updating the "Last updated" date and, where appropriate, providing additional notice.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to its conflict of law provisions.
